OFFERED ONLY TO LEGAL U.S. RESIDENTS (EXCLUDING CALIFORNIA, TENNESSEE AND UTAH), AGED 21 YEARS OR OLDER.
1. ELIGIBILITY: Open only to legal residents of the 50 United States (excluding California, Tennessee and Utah) and the District of Columbia who are 21 years of age or older as of the date of entry. Employees, officers and directors of Marnier-Lapostolle, Inc. ("the Sponsor"), its affiliates, subsidiaries, alcoholic beverage wholesalers and retailers, advertising and promotion agencies (collectively, "Sponsor and its agents") and immediate family members (spouses and siblings, children and parents and their spouses, regardless of where they live) or members of the same households (whether related or not) of such individuals are not eligible. Void in CA, TN, UT and where prohibited or restricted by law. All applicable federal, state, and local rules apply.
2. CONTEST DESCRIPTION: The Grand Marnier "The Grand Moments" Contest ("Contest") provides an opportunity for entrants to create a Grand Marnier ad which reinforces Grand Marnier's "The Grand Moments" campaign and describes a special moment in the entrant's life when he/she felt especially connected to a friend or friends. A Contest entry will consist of a photo and a headline uploaded into the contest ad template found at www.mygrandmarnier.com, and a story of 250 words or less describing this meaningful moment. The Contest entries submitted for each Entry Period (as defined in Rule 3) will be judged and the twenty-five (25) top-scoring entries for each Entry Period will be posted at www.mygrandmarnier.com for an Open Voting round, in which the public will vote to determine two Finalist winners who will each be awarded a Finalist prize and will be entered into Grand Prize Contest (see Rule 7).
3. TO SUBMIT AN ENTRY: Contest Entry begins on April 14, 2008 and ends on June 19, 2008 ("Contest Period"), and consists of four contest Entry Periods. The Entry Periods, which begin at 12:00:01 AM Eastern Time ("ET") on the first day of the Entry Period and end at 11:59:59 PM ET on the last day of the Entry Period, are as follows:

To enter, visit www.mygrandmarnier.com and access the Contest entry page for required registration and entry submission. Submit an entry that includes [a] an ad created by uploading into the contest's ad template a headline that reinforces Grand Marnier's ""The Grand Moments" campaign and a photo that depicts a special moment in the entrant's life when he/she felt especially connected to a friend or friends; and [b] a story of 250 words or less which describes this meaningful moment. The photo must have a minimum screen resolution of 300x300 pixels and no more than 800x600 pixels. Photo must be the property of the entrant; entrant must know the names and addresses of any identifiable persons in the photo, and must have permission from those persons to submit the photo. Entrants must submit a complete ad including a photograph, a headline and a story in order to qualify for judging.
Completed entries must be received by 11:59:59 PM ET on the last day of the Entry Period, to be included in that Entry Period's judging.
THERE IS A LIMIT OF ONE ENTRY PER PERSON PER ENTRY PERIOD. Entries must be completed in English. By submitting an entry, you grant permission, without limitation, for created ad with photo, headline and story to be displayed online as part of the Grand Marnier "The Grand Moments" Contest. Further, by entering you warrant and represent that your entry is your own original work created by you, is true and verifiable, has not been previously published, has not won a previous prize or award, that you own or otherwise control all of the rights to your entry materials and that your entry does not violate any law, regulation or any right of any third-party, including but not limited to rights of copyright, publicity and privacy. Submitting an entry that is copyrighted by another individual will make you responsible for any legal action the legal copyright holder might take action against you.
Entrants grant the Sponsor all rights of ownership, reproduction, and use of entries for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-free, worldwide right, in all media (now known or later developed) to assign, use, publish, edit, adapt, modify, alter, reproduce, distribute, display, copyright, create derivative works or otherwise exploit entries, for commercial or non-commercial use, and without compensation to the entrant. By entering the Contest, each entrant waives any and all rights he or she may have to the entry headline, story and photograph. To the extent entrant has any rights in the entry story, headline and photograph, the entrant assigns all such rights to the Sponsor by entering the Contest.
Entries may not defame or invade the rights of publicity or privacy of any person, living or deceased, or otherwise infringe upon a person's personal or proprietary rights. Submissions that are deemed by the judges in their sole discretion to be immoral, obscene, profane or not in keeping with Sponsor's image will be disqualified. Sponsor reserves the right in its sole discretion to disqualify any entry at any time which, in the Sponsor's reasonable opinion, endangers the safety or well being of any person or in the event it is determined that the entrant has not complied with these Official Rules. Other than for winner notification, neither Sponsor, nor anyone acting on its behalf, will enter into any communication with any entrant regarding this Contest, nor will entries be acknowledged or returned.
4. JUDGING: Entries will be judged initially by a panel of qualified judges from the Grand Marnier marketing team, creative partners and brand experts, based on the following judging criteria: ability to capture the Grand Marnier brand and image, adherence to the Grand Marnier global campaign theme "The Grand Moments", originality/creativity and clarity of expression (collectively or individually, the "Criteria") with equal weight being given to each Criteria element. In the event of a tie, the winner will be determined by the highest originality/creativity score. The twenty-five (25) entries for each Entry Period that receive the highest scores will be declared the Finalists. The photos, headlines and stories of the Finalists will be posted at www.mygrandmarnier.com, in the Ad Gallery, as part of the Open Voting.
5. FINALIST NOTIFICATION: The twenty-five (25) potential Finalists for each Entry Period will be advised of their having been selected by email and/or telephone on the dates listed in Rule 3. Finalists' entries will then be posted for Open Voting on the dates listed in Rule 3. ONCE AN ENTRANT HAS BEEN SELECTED AS A FINALIST, HE/SHE MAY SUBMIT NO FURTHER CONTEST ENTRIES.
6. OPEN VOTING AND FINALIST WINNERS: On the Open Voting Period dates listed in Rule 3, the twenty-five (25) Finalist entries will be displayed on the Contest site at www.mygrandmarnier.com, to be voted upon by the public. Visitors to the site may vote between 12:00:01 AM ET on the first day of the voting period and 11:59:59 PM ET on the last day of the voting period, for the Finalist whose entry, in the voter's opinion, best reflects the Contest theme of "The Grand Moments". Voters, who must be 21 year of age or older, will be required to register prior to voting. THERE IS A LIMIT ONE VOTE PER PERSON/EMAIL ADDRESS PER OPEN VOTING PERIOD. If it is discovered that an individual voted more than the permissible number of times, all of their votes will be void and they will be disqualified from the Contest.
The two Finalists who receive the most votes will each receive a Panasonic Lumix DMC-TZ3 Digital Camera valued at approximately $250, and will be entered into the Grand Prize Contest described in Rule 7. If for any reason the winners cannot be selected through Open Voting, including without limitation, as a result of a tie between/among the Finalists, insufficient or ineligible entries, voting, or any other reason, the Sponsor's judging panel shall select the winners based upon the judging criteria identified in Rules 4.
Finalist Winners will be required to sign and return a release form indicating their compliance with the Contest rules and confirming that their Contest entry is original and that they have all necessary rights in the entry as set out in these Contest rules. Finalist Winners will be required to prove eligibility by furnishing suitable identification that verifies their date of birth. In the event that a Finalist Winner cannot be contacted, does not return the release form or suitable identification within the prescribed time, that Finalist Winner will forfeit his/her prize and entry into the Grand Prize Contest described in Rule 7.
7. GRAND PRIZE CONTEST: The two Finalist winners from each entry period will be entered in the Grand Prize Contest in which the winning entries will be judged by a panel of Grand Marnier brand experts based on the how well the entry captures the Grand Marnier brand image and reflects Grand Marnier's global campaign. The following prizes will be awarded:
One (1) Grand Prize: a trip for four (4) people to Paris, France. Prize will consist of round trip coach air transportation for four people from the major commercial airport closest to winner's residence (as determined by Sponsor), hotel accommodations for 4 days/3 nights, a tour of the Grand Marnier distillery that will include a cooking/cocktail class, ground transportation, and a meal allowance of $570 per person. Expenses not specified herein are winner's responsibility. Approximate retail value of Grand Prize is $9,000.
One (1) First Prize: a weekend getaway for the winner and four (4) friends. Prize will be awarded as a travel voucher good for travel up to a maximum value of $4,000. It is the Sponsor's intention that the travel voucher be used for a weekend getaway for up to five people, but will be issued with no restrictions. Approximate retail value of First Prize is $4,000. Travel voucher is not redeemable for cash.
Actual value of trip prizes will be determined by winner's residence, destination chosen, and seasonal rates. Difference in amount between approximate retail value and actual value will not be awarded. Travel and accommodations are subject to availability and certain restrictions; blackout dates may apply. Winner and guests must travel at the same time on the same itinerary. Travel must be completed by June 30, 2009, or prize will be forfeited in its entirety. Travelers are responsible for any travel insurance and for all trip expenses not specified. If a rental car is part of the prize trip, winner or one of winner's guests must be 25 years of age or older and must have a valid U.S. driver's license in his/her state of residency, appropriate motor vehicle insurance, and a major credit card. Optional services or items such as refueling or loss or damage waiver (LDW) are extra. Guests of travel prize winners, who must be 21 years of age or older, must complete and return a notarized liability/publicity release prior to issuance of travel documents.
Two (2) Second Prizes: A Grand Marnier-sponsored dinner for the winner and up to four friends at a top restaurant. Prize will consist of dinner for up to five (5) people at a restaurant of the Sponsor's choice near winner's residence and an allowance for transportation to/from the restaurant. The total value of each Second Prize may not exceed $800. Prize does not include any alcoholic beverages. Selection of date and location for the dinner will be at the Sponsor's sole discretion. Attendees must be 21 years of age or older, must prove eligibility by furnishing suitable identification and must sign a liability/publicity release prior to attending the party.
Winners will be announced the week of July 7, 2008, and will be required to complete an affidavit of eligibility, a liability release, and (where legal) a publicity release, which must be returned by date specified in notification letter or an alternate winner may be selected.
8. GENERAL: All taxes on prizes and all expenses related to acceptance and use of the prizes not specified are the sole responsibility of winners. By participating, entrants agree: [a] to these rules and decisions of Sponsor and judges, which shall be final in all respects relating to the Contest; and [b] to release, discharge and hold harmless Contest Entities from any and all injuries, liability, losses and damages of any kind resulting from their participating in the Contest or their acceptance, use or misuse of a prize including, without limitation, personal injury, death and property damage, and claims based on publicity rights, copyright, trademark, defamation or invasion of privacy. Entrants agree to grant Sponsor: [a] all rights of ownership, reproduction and use of Contest entry for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-fee, worldwide right, in all media (now known or later developed) to assign, use, publish, edit, adapt, modify, alter, reproduce, distribute, broadcast, display, copyright, create derivative works or otherwise exploit entries, for commercial or non-commercial use; and if a winner, [b] to permit Contest Entities to use his or her name, photograph, likeness, Contest entry, biographical information, voice, voice likeness, and city and state address for advertising, publicity and promotional purposes in all media, including but not limited to within Sponsor's website www.mygrandmarnier.com, in perpetuity, without compensation (unless prohibited by law) and agree to execute specific consent to such use upon request. Contest Entities are not responsible for and shall not be liable for: [a] electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; [b] failed, incomplete, garbled or delayed computer transmissions; [c] late, lost, misdirected or incomplete entries or postage-due mail; or [d] any condition caused by events beyond the control of the Sponsor that may cause the promotion to be disrupted or corrupted. Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest or any portion thereof should viruses, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the Contest, and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion and to award the prizes from all eligible entries received prior to such action taking place. No prize transfer or cash redemption. No prize substitution, in whole or in part, except by Sponsor due to prize unavailability, safety or security considerations, or any other reason as solely determined by Sponsor in which case a prize of comparable or greater value will be awarded. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Internet entry must be made by the Entrant only at the authorized web site address of www.mygrandmarnier.com. Entries may not be made by any other individual or any entity, and/or originating at any other Internet website or e-mail address, including but not limited to commercial contest and sweepstakes subscription notification and/or entering service sites. Any person who enters by any of the methods described above will be disqualified. Use of any device to automate entry is prohibited. Sponsor reserves the right in its sole discretion to disqualify any entry at any time or prohibit an individual from participating in the Contest in the event it is determined that the Entrant [a] has not complied with these Official Rules, [b] attempts to enter the contest through any means other than as described in these Official Rules, [c] disrupts the Contest or circumvent the terms and conditions of these Official Rules in any way or [d] acts in an unsportsmanlike manner or with an intent to annoy, abuse, threaten, or harass any other entrant or Sponsor. This Contest is governed by the laws of the State of New York, with jurisdiction and venue in New York County, New York, and all claims must be resolved in the courts of New York County, New York.
9. ENTRY INFORMATION: Please note that by entering this Contest and by checking the "opt-in" box on the entry form for this promotion, you are [a] agreeing that the Sponsor may share your entry information (including your name, address, email address, etc.) with our promotional partners and other parties; and [b] granting us, our promotional partners and other third parties with which we choose to share your information, permission to contact you about our upcoming promotions, special offers or for other reasons. The collection and use of entrant information will be governed by Sponsor's on-line privacy policy, available for viewing at www.mygrandmarnier.com.
10. WINNER LIST: The names of the winners will be posted in the Winners Gallery at www.mygrandmarnier.com through July 25, 2008.
